General Terms and Conditions

1. Scope
The business connections between chrox-jewelry and its customers shall be subject to the legal requirements considering the following terms and conditions regarding terms of business business and payment. The version valid at the time the purchase order shall be applicable.

2. Offer, prices, minimum order value
Our offers are non-binding and subject to change. The presentation of our products in the online shop presents a non-binding online catalogue and serves as a non-binding offer. Commercial and reasonable changes in colour and structure concerning stone surfaces are reserved, as well as commercial and reasonable changes concerning the size of the stones and the piece of jewellery. Our prices are quoted in Euro including the statutory Value Added Tax (VAT). The Value Added Tax (VAT) = 10% (VAT for artists in Austria). Delivery charges will be charged separately (see 5.). We reserve the right to make technical changes or correct any error or misprint. Prices apply at the time of order. Special prices only apply for the time they are listed in our online shop. For orders and deliveries within and outside Austria there is no minimum order value.

3. Conclusion of the contract
How to order from the online shop:

1. Add selected articles to your shopping basket
2. Enter your delivery address and payment details
3. You have to review your specifications on the check slip
4. Accept the General Terms and Conditions
5. Click the “submit your order!” (“submit your order”) button to complete the transaction.

By completing the order process, entering the required details and clicking the “submit your order!” button as a last step you place a binding order.
After you have placed you order we will send you an e-mail to confirm your order. The order confirmation e-mail does not constitute acceptance of your order. The contract shall be concluded upon delivery.

4. Delivery and delivery period
Chrox-jewelry will deliver the product to the given address. If the ordered products are in stock delivery is normally effected within five working days, also depending on the selected form of payment. A customization specially of available rings and necklaces could lead to delay in delivery. Details about the delivery period are not-binding, unless a specific delivery date has been agreed. You can see the estimated delivery period for the products in the product specification. In case of delay of delivery or in case products are undeliverable we will inform you via e-mail or telephone. If necessary it is possible to make a part delivery. In this case we will pay the delivery charges for the delivery of further products. If products are undeliverable or cannot be delivered at the moment we will inform you promptly. In this case we reserve the right to withdraw from the contract and not to deliver the product, in case we are not responsible for non-delivery of our pre-supplier. If the payment has already been effected we will refund the sum paid. In case of the customer's non-acceptance of products free of defects, which have been delivered correctly and within a reasonable time, we will have to charge for all costs incurred (delivery charges, outside charges and bank charges).

5. Delivery charges
Within Austria:
Delivery charges EUR 29.90 per delivery for postage and packaging.

Countries within the European Union:
Delivery charges EUR 49.50 per delivery for postage and packaging.

Countries outside the European Union:
Delivery charges EUR 79.80 per delivery for postage and packaging.

Please note that in case of delivery to countries outside the EU costums charges may apply (e.g. delivery to Switzerland), which are not included in our invoice amount. In this case the customs charges, which will be charged directly by the customs, will be added to the total costs. On request we can ask for detailed information about customs charges – whether they will appeal and their amount.

6. Payment details
The amount will be due at the time of order, this also applies for pieces of jewellery which are not in stock.We offer various payment methods.

Cash in advance
This method of payment is available at any time. As soon as we have received the total amount on our bank account we will arrange the delivery.
Pieces of jewellery that are not in stock will be delivered right after production.

Paypal
You may effect your payment safely through the internet service provider Paypal, which provides all common payment methods such as debit note, credit card, giropay and credit transfer.

International payment transactions must be free of charge for chrox-jewelry. In case of non-compliance you will be charged for any additional bank charges or delivery will be reduced accordingly.
Payment and account details will be mailed to you upon placing your order.
You will receive your invoice upon delivery.

7. Reservation of proprietary rights
Prior to completion of the contract requirements the products remain in our property.

8. Cancellation policy

8.1. Right of withdrawal
You may withdraw from the contract, within two weeks after having received the product, without giving any reason by sending us an e-mail or a letter and by sending back the product. The termination period shall commence at the earliest upon receipt of the product and this notification. To observe the withdrawal period it is sufficient to send the notification of withdrawal and to send back the product on time to chrox-jewelry. This right of withdrawal doesn't apply to contracts of customized goods.

8.2. Withdrawal policy
In the event of a valid withdrawal each party shall return the goods and services and, if applicabe, any benefits (e.g. benefit of use) received to the respective other party. In case you are unable to return the received product in whole or only in part or only in a deteriorated condition (chrox-jewelry will take a picture and document the product prior to delivery), you will be required, if applicable, to pay compensation for the value insofar. This does not apply if the deterioration of the product is due to its examination (as usual in a retail shop). In general you can avoid the obligation for value replacement by not using the product as an owner and by refraining from doing anything which affects its value.

Attention: You will have to return products which can be sent in packages and you will be responsible for delivery charges in case the product received corresponds to the ordered product. Otherwise the return of the product will be free of delivery charges.Please note that returns must be sufficiently stamped. We will not accept packages and parcels free of postage. Payment obligations have to be met within 30 days. The customer's payment period commences at the time of sending the withdrawal notice, our payment period at the time of receiving this notice.End of withdrawal policy

9. Warranty and limitation of liability
The warranty is subject to the legal regulations. Should the product be defective, we offer the repair of the defect or a replacement delivery, depending upon your choice. In case the repair of the defect or the replacement delivery should fall short of expectations, you may return the product to us and obtain a refund of the full price of the product or demand a reduction of payment. Further requirements will remain unaffected. In case of replacement within the period of warranty there will not be any new periods of warranty. Chrox-jewelry will not give any warranty or liability for damages or defects arising for the following reasons: Inappropriate or unprofessional use, non-compliance with the operating instructions, natural wear and tear, defective or negligent handling.Insignificant difference in colour, measurements or other quality characteristics of the product cannot lead to the customer's warranty claim. Silver oxidation (blackening) is a natural process for which we cannot take any liability. Liability for natural wear and tear is excluded. Despite due diligence as to our products we cannot take any liability for the accuracy of the manufacturer's instructions, product descriptions and prices as well as misprints and malfunctions regarding this website and current availability of our products.

10. Data protection
All Customer's data transmitted shall be treated confidentially and used according to the Federal and Telesevervices data protection regulations. They will be saved exclusively for order processing, execution of services and for maintenance and evaluation of our customer database. All personal data transmitted, including your home address and e-mail address, shall be under no circumstances disclosed to any third parties except to associated companies for the sole purpose of fulfilling your order (e.g. The delivery company charged with the delivery of your products or the bank charged with the transaction process). In these cases the enclosed data will be limited to those really necessary. We have technical and organisational security measures in place to ensure the security of your information and to protect it against accidental or deliberate manipulation, loss, destruction or unauthorised access. Address and payment details will be encoded when passed on (256 bit SSL-Encoding).

12. Final provisions
The delivery is based on the General Terms and Conditions of chrox-jewelry. This Contract is governed by the substantive law of the Republic of Austria with the exception of the UN Convention on Contracts for the International Sale of Goods (CISG).
In case the customer does not have a domestic place of general jurisdiction or if the customer's domicile is outside of Austria or if the customer's domicile is unknown at the time of claim the competent court of jurisdiction is Hallein.
Should a provision of the contract be rendered ineffective, this does not affect the efficacy of all the other agreements. In this case the void provision is to be interpreted in a way which respects the purpose and interests of both parties.
